| الملخص: | The present research work has as antecedent the legal institution of Telework itself that was not always cataloged as an a priori option in our country since it did not guarantee its necessary viability to be used in a massive way is more was frowned upon from an employer point of view since it was implied that a person outside their workplace either at home or in a place different from that of their work was not going to generate an optimal performance, the present The general objective of the research is to analyze the Right to disconnection from work as a guarantee to teleworkers in the city of Guaranda during the year 2020 in addition, to determine the legal consequences that affected teleworkers as the Right to Disconnection has not been regulated, in relation to the fulfillment of an Ordinary Working Day In the development of the research, the ministerial agreements with which the Ministry of Labor regulates the labor modality of teleworking and the Organic Law of humanitarian support will be analyzed in detail, such as the ministerial agreement with Nro. MDT-2020-181 which contains the guidelines for the application of teleworking. Ministerial Agreement No. MDT-2022-035, regarding the technical standard to regulate the modality of telework in the public sector, giving it the importance and value that it brings as an alternative to the work supported by the regulations. It is intended to identify the nature and characteristics of the right to Telework and Disconnection from Work as a guarantee to teleworkers. The doctrinal assumptions of Telework and the right to Labor Disconnection will be based, in addition Ecuadorian legislation will be analyzed regarding the research topic, it should be noted that the research will be based on a mixed approach in order to achieve greater depth on the problem to be investigated, for a better understanding, two types of approaches will be used; on the one hand, the quantitative that will be appropriate at the time of conducting the 5 interviews as applied surveys and on the other hand a qualitative approacapproach will be used with respect to the analysis of the doctrine and normative bodies in force. |
