| Summary: | The proposed research work, drafted the consideration before the problematic fact named as obstetric violence considered as any conduct, action or omission, carried out by health personnel that, directly or indirectly, both in the public and private sphere, affects the body and reproductive processes of women, expressed in a dehumanized treatment, an abuse of medicalization and pathologization of natural processes. Obstetric violence practices are so naturalized among women that they ignore the existence of rights that are being violated, through the creation of a norm that sanctions the violation of women's obstetric rights, guaranteeing their right to have all the information related to their treatments, as well as the right to receive the best possible treatment from health personnel. An Empirical Method was used, which implied a direct investigation of reality. The Dogmatic Method which suggested examining the legal system to see if it meets the needs of society and, if not, how it can be improved. As a result of surveys and bibliographic review, a proposal was established on the modification of article 155 of book I, title IV, chapter II, section II, Therefore, the incorporation of an article establishing corresponding sanctions for professional malpractice and abuse of the same was firmly proposed, thus trying to reduce the rate of obstetric violence.
