Summary:This legal investigation was carried out given the need to study a problem generated from the spread of COVID-19 and the state of alarm generated globally by the largest pandemic that humanity has faced in recent years. In this case, strong controversies have been sparked on the issue of compulsory vaccination and respect for fundamental rights. Although the benefits of immunization against this disease are undeniable, there have been controversies regarding its application. However, vaccination rates were increasing, although some individual criteria linked to cultural traits such as religious beliefs, politics and others have considerably influenced acceptance to receive immunization. Given this problem, some questions arise related to the willingness to vaccinate and the exercise of certain freedoms considered as human rights, when a collision between the power of the State and these arises. This situation imposes the search for a balance between the individual decision to accept or not vaccination and the public health benefits of immunization. Faced with a pressing priority for health systems at all levels, States seek vaccination programs to be successful and for this they must have a high level of acceptance and in turn comply with the standards established in each country. The object of investigation that is carried out is about the protection of constitutional and human rights. A mixed research approach was used with an exploratory scope and as methods were used: inductive, deductive, historical- logical and analysis-synthesis. From this, the proposal of suitable legal mechanisms that contribute to the protection of constitutional and human rights in the face of the mandatory vaccination by COVID-19 in the Ecuadorian state will be made. For this, a historical legal analysis of the legal regulations, both national and international in force, that protect constitutional and human rights in the face of mandatory vaccination was carried out. At the same time, the contrasts between the social rule of law and the mandatory nature of the vaccine against COVID-19 were based on the principles of bioethics and socio-legal aspects
