סיכום:The labor context in Ecuador has been marked by the presence of a large number of self-employed workers who carry out their activities without being formally linked to a company. These independent workers, who include professionals, entrepreneurs and small business owners, play a crucial role in the country's economy, contributing to job creation and economic growth. However, the lack of guarantees and protections for self- employment has been a persistent problem; workers face challenges of legal insecurity, which is evident in Ecuadorian labor legislation, which is historically focused on protecting salaried workers, leaving self-employed workers in a regulatory limbo. The lack of laws leaves independent workers vulnerable to possible abuse and exploitation, limited labor rights being a factor in the lack of basic labor rights such as health insurance, pension, paid vacations and protection against unjustified dismissal, generating economic and social difficulties for workers and their families. The lack of social protection for self- employed workers means that many workers do not have adequate access to social security, which affects their well-being in the short and long term. The lack of guarantees for the execution of self-employment in Ecuador is a problem that must be treated urgently. To remedy this gap, it is essential that the Ecuadorian State take measures to improve the conditions of self-employment, since the present research work entitled “THE RIGHT TO SELF-EMPLOYMENT IN ECUADOR AND THE LACK OF GUARANTEES FOR THE EXECUTION OF THE SAME”, where relevant topics will be developed such as; Self-employment, definitions and characteristics; Work under a Dependency relationship; Quality of life and self- 4 employment; State Responsibility; Analysis of the Constitution, International Conventions and Treaties, Labor Code; In addition, a reform is proposed, implementing specific regulatory laws that guarantee basic labor rights, protect independent workers, facilitate access for self-employed workers to social security and social protection systems, providing coverage in case of illness, accidents or retirement, Taking into account that the protection and recognition of the labor rights of independent workers are fundamental to building a more fair and inclusive society. The implementation of policies and concrete actions contribute to improving the living conditions and well-being of workers and at the same time strengthen the country's economy. I hope that this investigative work constitutes a source of consultation for future generations of law students and professionals, in this way being able to have contributed to the solution of this problem that undoubtedly generates social commotion in Ecuador and that has to do with discrimination. towards the self-employed or self-employed worker.
