| description | La nueva concepción constitucional sobre el ordenamiento del Estado que se encuentra vigente en el Ecuador enfatiza la importancia de asegurar el desarrollo de la personalidad humana en la sociedad, dándole una alta prioridad a la voluntad y a la libertad, sin dejar a un lado los derechos humanos y la dignidad. Por lo tanto, el Derecho se ha encargado de proteger aquella figura que se conoce como la capacidad propia del ser humano que le permite realizar acciones de manera inteligente y racional, con el objetivo de actuar a voluntad propia, resguardando siempre los pilares fundamentales de esta sociedad, como lo es la libertad y los derechos humanos. El presente trabajo de investigación tiene como finalidad el análisis jurídico a realizarse ante una hipotética implementación de la muerte asistida en la legislación ecuatoriana. Dentro del mismo se podrá encontrar distintos antecedentes históricos y jurídicos relaciones a la muerte asistida o eutanasia. Finalmente, se realizará un análisis detallado de las normativas que se encuentran vigentes en el Ecuador que se verían afectadas por la implementación de la muerte asistida, así como un análisis comparativo entre distintas legislaciones alrededor del mundo en donde la muerte asistida si se encuentra permitida. |

Therefore, the Law has been in charge of protecting that figure that is known as the human being's own capacity that allows them to carry out actions in an intelligent and rational way, with the aim of acting at their own will, always safeguarding the fundamental pillars of this society, such as freedom and human rights. The purpose of this research work is the legal analysis to be carried out in the face of a hypothetical implementation of assisted death in Ecuadorian legislation. Within it you can find different historical and legal antecedents related to assisted death or euthanasia.
