| description | El presente trabajo de investigación realiza un estudio y análisis del artículo 157 del Código Orgánico Integral Penal referente a la violencia psicológica, su gradualidad en la escala de afectación, su juzgamiento y su derecho comparado con la legislación de Colombia y Nicaragua con la finalidad de establecer una comparación en procedimiento y juzgamiento de este delito. La violencia en el entorno familiar y en especial contra la mujer es una de las problemáticas latentes en la sociedad; En Ecuador la expedición del COIP marca un hito en la legislación penal respecto a la violencia contra la mujer y la familia, por tanto que el artículo 157, aparte de definir el tipo penal de la violencia psicológica, considera una escala gradual del daño psicológico: daño leve, moderado y severo; artículo que posteriormente es reformado por la Ley Orgánica Integral para Prevenir y Erradicar la Violencia contra las Mujeres, modificando la escala y estableciéndola por afectación o no de una enfermedad o trastorno mental. Esta escala permite al juzgador establecer una pena gradual con la ayuda de peritos especialistas que establezcan el nivel de trastórnanos psíquicos causados a la víctima por el agresor. |

Violence in the family environment and especially against women is one of the latent problems in society; In Ecuador, the issuance of the COIP marks a milestone in criminal legislation regarding violence against women and the family, so that Article 157, apart from defining the criminal type of psychological violence, considers a gradual scale of psychological damage: mild, moderate and severe damage; article that is subsequently reformed by the Organic Law to Prevent and Eradicate Violence against Women, modifying the scale and establishing it by affectation or not of a mental illness or disorder.
