Este organismo, dispuso en su normativa interna que el pescador artesanal podía beneficiarse de su condición, siempre y cuando pertenezca, previamente, a una asociación o cooperativa de tales condiciones. Si no es agremiado, simplemente el beneficio se le niega. Disposición en total contradicción con la normativa legal vigente, que expresa que el trabajador, puede acceder al beneficio, sin necesidad de estar agremiado como requisito indispensable. Esta dicotomía legal, atenta contra garantías expresadas en la Constitución y agrede la política del Buen Vivir, y un conjunto de derechos inclusivos como la salud, alimentación, jubilación, cesantías, etc. Hasta el momento se siguen vulnerando estos derechos, sin que el Consejo Directivo del IESS haya tratado de evitarlos o resarcirlos con una reglamentación adaptada a las garantías constitucionales que están en pleno ejercicio. |

This body provided in its internal regulations that the artisanal fisherman could benefit from his condition, as long as he previously belongs to an association or cooperative with such conditions. If he is not a member, the benefit is denied. Provision in total contradiction with the current legal regulations, which states that the worker can access the benefit, without the need to be a member of a union as an essential requirement.
