| spelling | Límites y avances de la justicia penal frente a las violaciones de derechos humanos en EcuadorEspinoza Pineda Mariuxi AlejandraHABEAS CORPUS CORRECTIVOGARANTÍA JURISDICCIONALPERSONAS PRIVADAS DE LA LIBERTADEL DERECHO A LA VIDAEL DERECHO A LA INTEGRIDAD PERSONALBDER-TPrG 247-2024Dentro de esta investigación, determinamos el objeto y alcance del Habeas Corpus correctivo, para proteger los derechos humanos de las personas privadas de la libertad, anotamos el cambio jurisprudencial vinculante que tuvo la Corte Constitucional del Ecuador, como resultado de los criterios «disímiles» de la justicia constitucional de primer y segundo nivel en el conocimiento y resolución de esta garantía jurisdiccional. La metodología utilizada fue el analítico, mediante el cual se analizó y se efectuó un estudio minucioso de los temas más importantes que guardan relación con el Habeas Corpus correctivo; también utilizamos el método sintético, mediante el cual reunimos elementos que se encontraban dispersados con el fin de relacionarlos y extraer las particularidades más importantes sobre este tema. Finalmente, concluimos que este tipo Habeas Corpus correctivo, no se encuentra desarrollada en la Ley, pero ha sido llenado de contenido por la jurisprudencia de las más altas Cortes de Justicia, dado que su ámbito de protección es el derecho a la vida e integridad personal de las personas que se encuentran con prisión preventiva o con sentencia ejecutoriada, las que en ciertos casos concretos podrían recuperar su [libertad], sin que aquello signifique una afectación a la seguridad jurídica del país.Within this research, we determined the object and scope of the corrective Habeas Corpus, to protect the human rights of persons deprived of liberty, we noted the binding jurisprudential change that the Constitutional Court of Ecuador had, because of the "dissimilar" criteria of the constitutional justice of first and second level in the knowledge and resolution of this jurisdictional guarantee. The methodology used was analytical, through which we analyzed and carried out a thorough study of the most important issues related to the corrective Habeas Corpus; we also used the synthetic method, through which we gathered elements that were scattered to relate them and extract the most important particularities on this issue. Finally, we conclude that this type of corrective Habeas Corpus is not developed in the Law, but has been filled with content by the jurisprudence of the highest Courts of Justice, given that its scope of protection is the right to life and personal integrity of persons who are in pretrial detention or with an executed sentence, who in certain specific cases could recover their [freedom], without that meaning an affectation to the legal security of the country.Universidad de Guayaquil.
