Este principio busca garantizar la igualdad ante la ley y la seguridad jurídica, evitando decisiones contradictorias para casos análogos sobre los mismos hechos. En resumen, el efecto inter comunis busca la aplicación uniforme de la justicia constitucional, dentro de situaciones similares de vulneración de derechos, pero su uso debe ser cuidadoso para no infringir los derechos procesales de individuos que no formaron parte del litigio original. La jurisprudencia y las decisiones de la Corte Constitucional deben fundamentarse adecuadamente para evitar la indefensión y asegurar la protección efectiva de los derechos constitucionales. Para llevar a cabo un estudio de caso sobre el efecto inter comunis en la justicia constitucional en Ecuador, se diseñará una metodología no experimental de orden principalmente cualitativa que aborde varias técnicas, entre las que se detallan la revisión documental de jurisprudencia y normativa nacional, además de publicaciones académicas, tesis, artículos de investigación, entre otros; por otro lado, se utilizará la técnica de campo para hacer una investigación basada en entrevistas, para lo que será necesario desarrollar como instrumento de investigación un formulario de preguntas de trasfondo del tema; Además de ello, se emplearán enfoques metodológicos de orden analítico y comparativo, puesto que se evaluará el problema en el Ecuador y en otros países de la región y sistemas jurídicos varios. En este mismo orden se encuentra también el destalle de las variables, las cuales evidentemente son el efecto inter comunis y adicionalmente principios constitucionales de seguridad jurídica y derechos constitucionales.The “inter communis effect” in the constitutional justice of Ecuador refers to the extension of the effects of a sentence to people who, without being part of the process, are in a legal situation similar to that of those who were within a public entity. This principle seeks to guarantee equality before the law and legal certainty, avoiding contradictory decisions for analogous cases on the same facts. In summary, the inter comunis effect seeks the uniform application of constitutional justice, within similar situations of violation of rights, but its use must be careful not to infringe the procedural rights of individuals who were not part of the original litigation. The jurisprudence and decisions of the Constitutional Court must be adequately founded to avoid defenselessness and ensure the effective protection of constitutional rights. To carry out a case study on the inter comunis effect in constitutional justice in Ecuador, a non-experimental methodology of a mainly qualitative order will be designed that addresses several techniques, among which are detailed the documentary review of jurisprudence and national regulations, in addition academic publications, theses, research articles, among others; On the other hand, the field technique will be used to carry out research based on interviews, for which it will be necessary to develop a form of background questions on the topic as a research instrument; In addition, analytical and comparative methodological approaches will be used, since the problem will be evaluated in Ecuador and in other countries in the region and various legal systems.
