El análisis de la causa Nro. 28-15-IN, emitida por la Corte Constitucional del Ecuador, se ha convertido en un antecedente y al mismo tiempo jurisprudencia, indicando con esta resolución la inconstitucionalidad de los numerales 2 y 4 del artículo 106 del Código de la Niñez y Adolescencia, en donde proponía a la madre como responsable de la tenencia del niño, niña y adolescente según lo manifestado en la ley, convirtiéndose de esta manera en inconstitucional al ir en contra de la Norma Suprema que establece que todo ecuatoriano tiene derecho a la igualdad y no discriminación. Al tratarse de un fallo con carácter vinculante permitirá que los jueces tomen resoluciones asertivas en pro del bienestar de los niños, niñas y adolescentes. De esta manera, se realizara el análisis y seguimiento del proyecto de Código Orgánico de Protección Integral de Niñas, Niños y Adolescentes (COPINNA) y una propuesta para reformar el CONA en su artículo 106 Numeral 2 y 4, el mismo que debe incorporar en sus articulados los fallos de la Corte Constitucional y acogiendo el criterio jurídico emitido por la coordinación legal de la Asamblea Nacional. This research work, entitled THE RIGHT OF PARENTS TO EQUALITY IN FRONT OF THE BEST INTEREST OF BOYS, GIRLS AND ADOLESCENTS IN SHARED TENURE, has the general objective of presenting a critical and legal analysis of the right to equality enshrined in our Constitution in shared tenure through the contrasting of Comparative Law, Ecuadorian Regulations and Bill to propose viable alternatives that solve said problem. The analysis of case No. 28-15-IN, issued by the Constitutional Court of Ecuador, has become an antecedent and at the same time jurisprudence, indicating with this resolution the unconstitutionality of numerals 2 and 4 of article 106 of the Code of Childhood and Adolescence, where it proposed the mother as responsible for the custody of the child and adolescent as stated in the law, thus becoming unconstitutional by going against the Supreme Norm that establishes that all Ecuadorians have right to equality and non-discrimination. As it is a binding ruling, it will allow judges to make assertive resolutions in favor of the well-being of children and adolescents. In this way, the analysis and monitoring of the rights of equality and Non-discrimination will be carried out, of the main aspects taken by the judge to consider what is the Best Interest of the child in each case, a brief approach to the Organic Code project of Comprehensive Protection of Girls, Boys and Adolescents (COPINNA) and PROJECT OF AMENDMENT LAW TO TITLE II - BOOK II ORGANIC CODE OF CHILDREN AND ADOLESCENCE in its article 106 Numeral 2 and 4, the same that must incorporate in its articles the rulings of the Constitutional Court and accepting the legal criteria issued by the legal coordination of the National Assembly.Universidad de Guayaquil.
