En la actualidad se presencia una época llena de violencia, narcotráfico, delincuencia que junto a otras problemáticas como, los altos índices de pobreza, los hogares disgregados, la falta de atención y cuidado de los padres, han provocado que menores delincan. Pues bien, este estudio está enfocado en determinar qué produce que nuestro sistema penal juvenil no esté cumpliendo con la finalidad que establece el Código de la niñez y adolescencia en el art. 371, debido que se sigue evidenciando altas cifras de delincuencia y reincidencia de menores de edad. Definitivamente, faltan esfuerzos y corresponsabilidad entre el Estado, familia y, sociedad para otorgar las herramientas necesarias y óptimas con el fin de que haya una verdadera reintegración social y evitar la reincidencia de los adolescentes infractores.The present research work seeks to establish the causes of the lack of effectiveness of socioeducational measures and effectiveness measures in the reintegration of adolescent offenders. Currently, we are witnessing a time full of violence, drug trafficking, and crime that, together with other problems such as high poverty rates, broken homes, and lack of parental attention and care, have caused minors to commit crimes. Well, this study is focused on determining what causes our juvenile criminal system to not be fulfilling the purpose established by the Childhood and Adolescence Code in the 371 article, due to the fact that high figures of crime and recidivism among minors continue to be evident. There is definitely a lack of efforts and co-responsibility between the State, family and society to provide the necessary and optimal tools in order to achieve true social reintegration and prevent recidivism of adolescent offenders.Universidad de Guayaquil.
