| spelling | Alcances y limitaciones conceptuales del acceso carnal en el Código Orgánico Integral Penal.García Cedeño, Mayra MilenaRivera Pinargote, Cristopher RenatoACCESO CARNALACCESO CARNAL PASIVOVIOLACIÓN INVERSAFELACIÓN ACTIVA.BDER-TPrG 177-2024El presente trabajo de investigación tiene como fin evidenciar la necesidad de incluir en el Código Orgánico Integral Penal a el acceso carnal pasivo como elemento constitutivo del tipo penal violación a través del análisis de la sentencia de mayoría y el voto salvado dentro de la causa No. 24281201901415, mediante el método hermenéutico se examina el tipo penal violación según la teoría del delito, utilizando el análisis comparado en la jurisprudencia española y peruana las cuales si admiten los términos: “acceso carnal pasivo” y “felación activa”, se demuestra la necesidad de expandir los alcances de la definición de acceso carnal en la legislación ecuatoriana lo que daría como resultado una mejor calificación jurídica del delito de violación en casos cuyo supuestos de comisión del delito contemplen felación activa y violación inversa The purpose of this research work is to demonstrate the need to include in The Integral Criminal Organic Code passive carnal access as a constitutive element of the criminal type of rape through the analysis of the majority sentence and the saved vote within cause No. 24281201901415, by means of the hermeneutic method, the criminal type of rape is examined according to the theory of the crime, using the comparative analysis in the Spanish and Peruvian jurisprudence, which do admit the terms: "passive carnal access" and "active fellatio", the need is demonstrated to expand the scope of the definition of carnal access in Ecuadorian legislation, which would result in a better legal classification of the crime of rape in cases whose assumptions of commission of the crime contemplate active fellatio and reverse rape.Universidad de Guayaquil.
