Como objetivo se busca realizar un enfoque del derecho de una persona a concebir mediante un procedimiento artificial o asistido para contrastarlo con el derecho del hijo concebido en estas condiciones a su identidad personal y biológica. La metodología utilizada tiene enfoque cualitativo, puesto que permite describir el contexto y las teorías que han influido respecto al tema de estudio, así como la recopilación de datos de origen documental y especializado en el campo sanitario y en el área jurídica. Se concluye que tanto el derecho a la reproducción como el derecho a la identidad son importantes y se encuentran consagrados y garantizados a nivel convencional y constitucional, por lo que se le debe proporcionar una mayor atención a estas prácticas o procedimientos asistidos o artificiales, mediante una correcta regulación jurídica y a efecto de que ningún derecho se vea afectado.This paper analyzes the effects of the application of assisted or artificial human reproduction techniques in Ecuador, in accordance with which the weighting that should exist between the right of parents to procreation and the right to identity of children born as a result of these treatments is studied. The objective is to focus on the right of a person to conceive by means of an artificial or assisted procedure in order to contrast it with the right of the child conceived under these conditions to his or her personal and biological identity. The methodology used has a qualitative approach, since it allows describing the context and the theories that have influenced the topic of study, as well as the collection of documentary and specialized data in the health field and in the legal area. It is concluded that both the right to reproduction and the right to identity are important and are enshrined and guaranteed at a conventional and constitutional level, so that greater attention should be paid to these assisted or artificial practices or procedures, through a correct legal regulation and so that no rights are affected.Universidad de Guayaquil.
