| description | This scientific research addresses a topic that is little known in the national market and its purpose is to introduce the reader to smart contracts, known as smart contracts. A descriptive and documentary analytical methodology was used to analyze both their terminology and specialized concepts, as well as the possible advantages and disadvantages when celebrating them, to obtain a critical vision of the new paradigm of technology and innovation and the need for a minimum regulatory framework. That guarantees compliance with the general principles of Private Law, in particular the principle of good faith and the autonomy of the will in observance of the international norms of Commercial Law. The results of the study contribute to the democratization of knowledge in order to arouse interest in the use of this new contractual modality. In this way, it seeks to promote legal progress and commercial traffic as mechanisms for the development of the country’s economy. |

Guarda como finalidad introducir al lector a los contratos inteligentes, conocidos como smart contracts. Se utilizó una metodología analítica descriptiva y documental para analizar tanto su terminología y conceptos especializados, como las posibles ventajas y desventajas al momento de celebrarlos, para obtener una visión crítica frente al nuevo paradigma de la tecnología e innovación y la necesidad de un marco regulatorio mínimo que garantice el cumplimiento de los principios generales del Derecho Privado, en particular el principio de buena fe y la autonomía de la voluntad en observancia de las normas internacionales del Derecho Comercial. Los resultados del estudio contribuyen a la democratización del conocimiento a efectos de despertar el interés en la utilización de esta nueva modalidad contractual.
