Mala aplicación del régimen de visita y pensiones alimenticias

This research work studies the repercussions of the incorrect implementation of the system of visitation and alimony on the emotional, psychological and material well-being of children in our country. Although the visitation system aims to ensure the right of the child to maintain a relevant relationship with both parents, its noncompliance causes impacts on family dynamics. Difficulties are identified such as the interruption of visits by the parent guardian, the transgression of established schedules and the lack of coordination for their correct application. This analysis explores the theoretical and legal framework that regulates family law in Ecuador, emphasizing the best interests of the child, constitutional principles, and the provisions of CONA. The methodology focuses on a combined approach between the qualitative study of regulations and academic research and the quantitative study with questionnaires and interviews with the legal community. The results show that the interruption of the visitation system violates fundamental rights and affects the child's integral development.
