La retención voluntaria a prorrata del sueldo que percibe el alimentante a fin de sustituir la medida cautelar de salida del país

In the present research work, it will be analyzed whether the voluntary retention in proportion to the salary received by the breadwinner is a suitable means to replace the precautionary measure prohibiting the child from leaving the country; proposing it as an alternative measure to permit the provisional lifting of the precautionary measure, since Ecuadorian legislation provides for the termination of the measure imposed, It is necessary to comply with all the obligation or provide sufficient guarantee to cover it and, even if maintenance has been paid on a continuing basis, to maintain outstanding payments; makes it impossible for the feeder to be released from precautionary measures. For this reason the present work focuses on the type of documentary, field, descriptive and explanatory research in view of the fact that information will be collected through the reading of documents of all kinds, whether legal journals or books, to obtain records on the problem posed, applying the methods of deductive, inductive and systematic research to be able to develop with better understanding the topic to be dealt with. In turn, a quantitative and qualitative approach will be used to supplement the information collected through surveys and interviews……..
