El abuso de la medida cautelar de prisión preventiva y sus incidencias en un proceso penal violenta la presunción de inocencia

In the present research project, the topic THE ABUSE OF THE PREVENTIVE DETAINMENT PRECAUTIONARY MEASURE AND ITS INCIDENCES IN A CRIMINAL PROCESS VIOLENTS THE PRESUMPTION OF INNOCENCE was conducted. Its general objective Analyze the abuse of the precautionary measure of preventive detention and its incidence in a criminal process that violates the presumption of innocence. The first chapter of the project consisted of analyzing the problems of the study for the formulation of the research question, objectives, justification, idea to defend and delimitation. In chapter two, the theoretical framework was developed through the compilation of bibliographic sources related to conceptual, legal, and jurisprudential aspects. Chapter three was related to the design of the methodological framework, through the compilation of bibliographic sources related to conceptual framework, through the appropriate methods for obtaining the necessary data for the development of the research project. Coming to the conclusion that the proposed structure followed, allowed through theoretical arguments to establish in the parameters of the abuse of the personal precautionary measure of preventive detention, the consequences that originated, the violation of the right of presumption of innocence.
