| Итог: | The general objective of this investigation was to analyze the applied method of customs valuation that is applied in smuggling crimes in order to determine the evaluation of the evidence and its impact within the direct procedure when qualifying the flagrancy that would be indicated in these cases as determined by law, for this the probative value was determined and the way in which the evidence should be carried out and evaluated as well as it was recommended to establish a specific sanction for the entry of this type of illegal content, considering that it be more rigorous and strict for this type of crimes whose container inspection is very deficient in this country. The method used has been based on the qualitative approach since an analysis of the regulations that refer to smuggling crimes in general was practiced and carried out, as well as we focused on in-depth interviews and surveys. The results obtained showed that although in criminal matters a conflict arises with respect to the procedure for the qualification and evaluation of evidence obtained in flagrante delicto, that is, at the moment the criminal act is committed at customs, for example at the time a container is exporting or importing products subject to inspection, in this type of situations, in accordance with the provisions of the Comprehensive Organic Criminal Code, the direct procedure is applied as a legal consequence of the flagrante delicto of such crime. |
