Implementación del uso debido del cannabis como fuente medicinal en nuestro código orgánico integral penal

This research was directed to the study of the implementation of the proper use of cannabis as a medicinal source in the Ecuadorian Integral Penal Organic Code considering that this plant in other countries already has a normative regulatory framework for its consumption in the treatment of pathologies, and there are also studies made by international health organizations that support it. It should be noted that in Ecuador the Drug Law was issued where the use of controlled substances is authorized for medicinal purposes but the existence of a normative framework that still penalizes them has prevented people who require cannabis as part of their constitutional right to health and good living, they are forced to use other means for their acquisition. Through the collection of quantitative and qualitative data it was possible to demonstrate the support of the group, involving a doctor, judges and lawyers, against the decriminalization of cannabis for medicinal purposes; being a subject that is still debated in the country while the injured are people who must face daily a clinical state that could be coped with dignity through the administration of cannabis. Based on the above, the project culminates with the presentation of a reform to the Second Section of the Comprehensive Criminal Code referring to "Offenses for the production or illicit trafficking of controlled substances subject to control" where aspects that have limited access are sanctioned of medicinal cannabis in the country………
