It analyzes the Organic Law of Identity Management and Civil Data article 37 that establishes a hierarchical and preferential order at the moment that a couple must register their son or daughter in the absence of an agreement and the voluntary nature that they bear the maternal surname. If the first son or daughter is registered with the paternal surname, the others that may be born must follow said paternal line in the same way, even if there is later disagreement. The present investigation has a qualitative as well as a quantitative approach, which allowed us to cover the problem in depth.
