Las dificultades se presentan cuando deben fijarse criterios que brinden un englobado material, sobre todo considerando el pedestal político que subyace en este principio, por cuanto el fallo de interponerse penalmente es del asambleísta. Necesariamente, una de las particularidades del Derecho penal actual es su representación de prima ratio, por lo que resulta imprescindible investigar argumentos para forzar cuándo es necesario el Derecho penal, en términos de eficacia y lógica. Es frecuente alegar, cuando se examinan los límites al poder punitivo del Estado, que uno de los principios más importantes es el de ultima ratio, entendido como una de las memorias del principio de necesidad de la mediación del Derecho penal.
