Summary:The investigation starts from the appreciation of a legal problem due to the untimely dismissals due to the breach of the contractual relationship between the employer and the worker, in such a way that the general objective is to critically analyze the breach of contract as a cause of untimely dismissals based on a doctrinal analysis in order to determine the theoretical bases that justify the need for an alternative dispute resolution mechanism in labor matters. The problem occurs due to the breach of the contractual relationship, as a reason for the termination of employment, which affects a legal problem thus causing the worker an untimely dismissal by the employer. Considering that the types of research used are qualitative and quantitative of mixed term, verified in our field study to be carried out, which will be carried out through surveys directed to professionals of labor law enrolled in the Guayas Law School and interviews directed to former workers who are identified with the exposed problem, in such a way statistically resulting in the main contractual breaches, the main violations of labor principles that arise from untimely dismissals, establishing the theoretical viability of the implementation of a previous stage based on the application of alternative methods of conflict resolution............
