La responsabilidad del estado ecuatoriano en la protección del derecho a la integridad, de las personas privadas de libertad del centro de privación de libertad de personas adultas en conflicto con la ley de Riobamba

ABSTRACT: Acts of torture and the living conditions of people deprived of liberty [PPL] in Ecuador are problems that are recognized at the national and international levels. The integrity of the individuals who are confined within the Social Rehabilitation Center of the city of Riobamba is affected by the existence of several critical issues such as isolation, overcrowding, inadequate infrastructure, lack of prison personnel, and shortages of basic services that cause violation of this right. The Constitution of the Republic of Ecuador [CRE] prioritizes the applicability of the rights established therein. According to article 51, persons deprived of liberty enjoy rights, such as protecting their personal and sexual integrity, which must be guaranteed by the Ecuadorian State, considering that its highest duty is to ensure effective compliance with the rights recognized in the Constitution and international instruments. That is why the purpose of this investigation is to determine through methodological mechanisms whether the lack of adequate supervision by the Ecuadorian State affects the violation of the right to integrity of people deprived of liberty. This research has a mixed approach, with a descriptive scope and a non-experimental design. In addition, it has been considered essential to include people deprived of liberty in the data collection by applying a survey to obtain direct perspectives of those who are being affected and, in this way, be able to develop a proposal that contributes to the protection of the integrity of people imprisoned in the country's prisons. Through the study of jurisprudence and reports related to the protection of the integrity of persons deprived of liberty and after the analysis of the results obtained through the application of the survey, it was concluded that, due to lack of adequate supervision, by the Ecuadorian State has seen the right to integrity of people deprived of liberty violated in the Social Rehabilitation Center of the city of Riobamba.
