Zusammenfassung:Abstract Marriage is a legal institution in which two people voluntarily decide to join their lives, acquiring rights and obligations, within the obligations that the spouses must follow is sexual exclusivity, when breached, the affected spouse will start a demand for divorce because of adultery stipulated in the Ecuadorian Civil Code in article 110, numeral 1, adultery is the act by which a person has sexual relations with another person other than their spouse. That is why to verify this fact, the parties will practice different means of proof that would expose the sexual life of the people involved, which would violate the right to individual and family privacy that is established in the Constitution of the Republic of Ecuador. This research project will investigate and analyze doctrinally and legally the practice of evidence in divorce processed for the cause of adultery, and the right to privacy that is violated by exhibiting the sexual practice of the intervening persons.
