Los peritajes psicológicos y de rasgos de personalidad realizados a la víctima y al procesado en casos de violencia psicológica y su incidencia en la valoración probatoria

Psychological violence is a social phenomenon that is immersed in the daily life of individuals and where a large percentage have been victims of this crime. Processes for psychological violence have suffered an upturn in recent years and where the importance has been verified within the procedural evidentiary context of the expert opinion on personality traits and psychological assessment, which are applied to both the victim and the perpetrator by a expert forensic psychologist, allows to determine the degree of affectation that the victim has suffered or not, leading the judge to be convinced of the facts and circumstances of the offense and therefore, the responsibility or not of the person processed. The research is based on a legal - doctrinal, legal - analytical, inductive and descriptive methodology. With a qualitative approach, interview techniques, instruments, study and review of documents have been used, establishing that psychological violence is a form of serious aggression, since it leaves sequelae in the victim's psyche, thus affecting their emotional state., even going as far as directing them to suicide.
