Summary:The present research is about the “COMPARATIVE ANALYSIS BETWEEN CONTRACTS OF: CIVIL AND COMMERCIAL LEASE IN ECUADORIAN LEGISLATION”., it is composed by several parts: first, it was necessary to separate both legal and civil concepts, both the public and commercial leases and secondly place to analyze the similarities and differences between both contracts. The civil lease is a contract, which is celebrated between the lessor and owner of the property, thay undertakes to deliver if for use in exchange for a value, and on the other hand, the lessee, who in exchange for the use of the property agrees to make a payment called a lease fee. Whereas, the commercial lease is a contract by which a financial leasing company acquires a property previously requested by the client, whit the purpose of leasing it exclusively to it, in exchange for which the client or lessee has the obligation to pay a value, which adds the capital invested in the good, as well as the interest, however, at the end of the lease, the property remains the property of the financial leasing company. Despite the fact that both contracts are caked leases, their treatment is entirely different, so it was also necessary to study their various aspects, such as those related to the obligations of landlord and tenant in both contracts and how to terminate them in advance.
