This research aims to analyze the legal and doctrinal of the application of disinheritance; due to abandonment in a state of dementia or helplessness to their parents. Our Civil Code from article 1230, explains what disinheritance is as a testamentary disposition, the causes for it to occur, the effects and requirements, in addition to the revocation of the disinheritance. Although it is true, the revision of the rule explains what this legal institution is. It also specifies when it occurs and which cases it would be applicable. In the same way, we begin to analyze what unworthiness is within successions and how it is related to disinheritance. This paper explores what the topic of discussion consists of, starting by focusing on the principles of adults and the state of dementia or helplessness. Then we will analyze why the rights of adults are being violated within their own nucleus family. On this basis, we will define the general rules of disinheritance. We will also study disinheritance in a better way, starting from specific legal terminology within successions. Finally, we will identify the effects of abandonment in a state of dementia or helplessness of the parents and on disinheritance, making a critique of how this legal institution is currently understood.
