La acción extraordinaria de protección y el tránsito del control de arbitrariedad judicial a órgano que realiza un control de mérito de fallo.

The objective of this research project is a legal, descriptive and comparative analysis based on jurisprudential antecedents resolved by the Corte Constitucional del Ecuador, in which various positions on merit control are reflected through the Extraordinary Protection Action on sentences of jurisdictional guarantees in constitutional matter. The investigation was carried out according to parameters of comparison and description in different constitutional rulings, which show largely disparate criteria in terms of control of merits on sentences of jurisdictional guarantees, to finally determine that the control of merits is legally specified through of the Extraordinary Protection Action after compliance with the parameters established by the highest body of interpretation and constitutional control, and this through its binding jurisprudence. Therefore, it was suggested to set up an educational scheme in the virtual field where law students and professionals are aware of current jurisprudence, through comparisons and critical reflections obtained from these tools.
