| Riassunto: | ABSTRACT The present study addresses the problem of the violation of the rights of the LGTBI group in the community jail of the city of Riobamba and Latacunga. The COIP and the Care Protocol for LGTBI people establish standards for the separation and treatment of this group in detention centers. The lack of recognition of sexual orientation in the separation of persons deprived of liberty is highlighted, which is not in harmony with Art. 7 of the COIP, since sexual orientation is not considered in the separation of people deprived of liberty of the LGTBI group. For this reason, a critical analysis will be carried out of the rights that are violated by LGTBI people in detention centers, to establish strategies that improve the quality of life of people deprived of liberty who belong to this group. The methodology used in the research is quantitative and qualitative, instruments such as interviews with Criminal Guarantees Judges and psychologists from the SNAI, surveys of the LGTBI group were used. From the results obtained, it is established that in fact, the norms that regulate the separation of people are not in harmony with the sexual orientation of some inmates, concluding that discrimination and abuse within the deprivation centers for the LGTBI group starts from the norm.
