Análisis jurídico y doctrinal del habeas corpus correctivo: Sentencia de la Corte Constitucional No. 253-20-JH/22.

The habeas corpus protects three fundamental rights: the right to liberty, life, and physical integrity. Therefore, it is conceived as a constitutional measure, considered a technique for protecting human rights, and it is essential to articulate the entire legal system of each technique that permits the practical safeguarding of fundamental rights. In this sense, the present research project establishes a legal and doctrinal analysis of corrective habeas corpus. Taking as the unit of analysis the judgment of the Constitutional Court No. 253-20-JH/22, based onthe conception that corrective habeas corpus is not expressly established in our regulations, but rather that our legislation takes into account the constitutional guarantee of habeas corpus in a general way. However, in said sentence, the classification is made, and the corrective habeas corpus is incorporated within it, opening the gap to the possibility of its application for the protection of personal physical integrity and related rights of a person deprived of liberty. The researcher assumes a qualitative approach to the study of the legal problem. The descriptive, historical-logical, legal-doctrinal, and deductive methods are used in the non-experimental design.
