La letra de cambio como título de formación sucesiva.

ABSTRACT: The present research project entitled "The Bill of Exchange as a Title of Successive Formation" focused on the normative applicability around this topic and the impact generated by the enforceability of the bill of exchange signed in blank on the rights of the signatories. The research was carried out in the city of Riobamba and used a qualitative approach combining legal-analytical, dogmatic, and legal-doctrinal methods. From a doctrinal and jurisprudential approach, it was possible to identify that the successive formation of the bill of exchange is fully applicable since, when the subscriber signs a document, it is understood that they agree with the information contained in the title. In the social sphere, executing a bill of exchange that has been subscribed in blank can generate significant economic damages in the drawee's peculium. The research methodology adopted was non-experimental. An interview with a questionnaire of 8 questions was applied to a population of 15 judges assigned to the Civil Judicial Unit and the First Civil and Commercial Court. The intentional and non-probabilistic sample was reflected in 4 judges of the Civil Judicial Unit. These results reflected a significant tendency of non-conformity with respect to the clarity of the current and current regulations on the proposed topic. However, divergent opinions were also obtained, expressing conformity with the clarity of the current rules.
