That judgment analyzes the legal concept of tenure, considering that the Ecuadorian Code of Children and Adolescents handled criteria and parameters to grant it preferentially to mothers. This way is how it determines that paragraphs 2 and 4 of Article 106 of the code above violate constitutional rights and are not based on the best interests of minors. Since the mother preferred the law, the only thing that took precedence was gender stereotypes, but not the guarantee of the children's rights. In addition, an analysis of the rights of minors and the legal figures of possession and parental authority will be carried out. |

In addition, an analysis of the rights of minors and the legal figures of possession and parental authority will be carried out.La presente investigación titulada: “La sentencia de la Corte Constitucional N° 28-15- IN/21 y su incidencia en los derechos de los menores”, se realiza con el propósito de analizar a través de un estudio jurídico crítico, cómo la mencionada resolución incide en los derechos de los niños, niñas y adolescentes. En efecto, dicha sentencia analiza la figura jurídica de la tenencia, teniendo en cuenta que el Código de la Niñez y Adolescencia ecuatoriano, manejaba criterios y parámetros para otorgarla, de manera preferente a las madres, es así como determina que los numerales 2 y 4 del Art. 106, del mencionado código violentan derechos constitucionales y no se basan en el interés superior de los menores, puesto que al ser la ley preferente a la madre, lo único que se estaba primando, eran estereotipos de género, más no, la garantía de los derechos de los hijos.
