Aggiungi Tag | Riassunto: | ABSTRACT The present research work entitled Proportionally in the administrative sanctioning procedures processed in the Council of the Judiciary and the impact on the decisions adopted in the sanctioning procedure and the relationship with the principle of proportionality will aim to conduct a legal study of the administrative sanctioning procedures in the Council of the Judiciary of Chimborazo and verify whether it complies with the principle of proportionality. That is, applying this principle contributes to an adequate and exemplary sanction to correct the offender's actions through the weighting and graduation of the sanction according to the offense under compliance with the principles of proportionality, impartiality, and due process. Also, verify the differences between the sanctioning procedure and the disciplinary procedure. To verify the research hypothesis, two sanctioning processes will be analyzed, and surveys will be applied to lawyers from the Chimborazo Bar Association. Finally, conclusions and recommendations will be drawn to improve the administrative sanctioning process in the Judiciary Council of Chimborazo.
