| सारांश: | ABSTRACT: The present study focuses on social rehabilitation regimes in Ecuador, especially the semi-open regime, as a penitentiary measure due to the need to gradually reintegrate criminals into society. The research analyzes the legal reforms, particularly Article 113 of the Organic Reform Law to the Comprehensive Organic Penal Code (COIP), which modifies the semi-open regime. Thus, the restriction of access to it for certain groups of persons deprived of liberty (PPL) is being investigated, which contradicts constitutional principles. Therefore, the main objective of this research is to determine if the semi-open regime fulfills its purpose of social reintegration, considering the reforms to the COIP and the established standards. For this purpose, a population of 10 Criminal Guarantees Judges was determined. Bibliographic and legal techniques were used to collect information, using inductive, legal-analytical, descriptive, and dogmatic methods with a qualitative approach. The results reveal that the semi-open regime does not meet its primary objective of social reintegration, evidencing deficiencies in the penitentiary system, such as the lack of crime prevention and insufficient state action to guarantee the rights of the PPL. It is concluded that the semi-open regime has become a tool reflecting a lack of ethics and manipulation of the judicial system by the political class. The need for structural reforms in the Ecuadorian prison system is highlighted to guarantee proper social reintegration of individuals deprived of Liberty. |
