La valoración de la opinión del niño bajo el principio del interés superior y su incidencia frente a la fijación del régimen de tenencia ordenada por la unidad judicial de la familia, mujer, niñez y adolescencia del cantón riobamba en el período diciembre 2014

This research is aimed at determining the effects that the child's 0pinion exerts in court, fixing tenure to identify the extent of the effects. The first chapter called Reference Framework, which discloses what the backgrounds of the research were, this is the statement of the problem, the formulated problem isin this chapter, specifying the problem studied, for which it has set a general objective and specific objectives, and finally it discloses the importance of this research work. In the second chapter called Theoretical Framework, appears the information that has been obtained from the legal system, and in this case a study of international treaties on the rights of children, doctrine and jurisprudenceis necessary to conduct This chapter is made of four units: The first unit deals with the opinions of the child, it contains the historical reference, the principle of the best interests of children, the level of responsibility in carrying out the interests of the child, the child's rights, different definitions of the child´s opinion, the object pursued, the scope, a study on the ruling of the Constitutional Court regarding the interests of the child. The second refers to the holding unit and its content, it alsocomprises, the historical review, the concept, terminology and legal difference between custody and possession, object, features, Constitutional Framework, the persons involved in tenure, and the fixing processes that can start tenure, this is a divorce by mutual consent and contentious general. The third unit refers to the effects that the children´s opinions exert in the tenure process, thus, establishing general notions about the legal effects. In the third chapter called methodological framework of the hypothesis, testing is performed based on the processing and interpretation of the results obtained in the course of the investigation, for which the inductive and descriptive methods, are used, while the technique used was the one done through the interview guide. Conclusions and recommendations made in accordance with the results of the investigation are set out in the fourth.
