Crynodeb:The health emergency caused by COVID-19 in 2020 in Ecuador has greatly impacted the workplace. As a result of this epidemic, a new work modality has been used, choosing as the best option the implementation of telecommuting or remote work. Seeking this way to provide a quick and fruitful solution to sustain the economy and development of the country. Based on a legal and doctrinal study, the objective of this titling work is to determine if there is a violation of the right to payment for performing overtime, supplementary and night hours under the teleworking modality. The investigation had a mixed approach since its study was based on the normative, doctrinal, and practical confirmation, seeking to identify what the norms and legal bodies stipulate are used in labor practice. Among the main results, it was determined that the workers of the "Vehicentro" concessionaire in the city of Ambato were unaware of the teleworking modality before the pandemic, mainly because they were used to only working in person. Because of this, a legal reform is proposed that guarantees the right to remuneration for payment of overtime, supplementary and night hours in teleworking modality, in addition, that the worker be provided with the equipment and implements necessary for his good performance at work, respecting the hours stipulated in the Labor Code.
