Περίληψη:ABSTRACT: When an individual is deprived of their freedom, it is crucial to ensure that the justifications behind the judicial order are valid. Despite Ecuador's transition from an inquisitorial criminal system to an adversarial one in 2008, with the presumption of innocence as a cornerstone, securing a precautionary measure that infringes upon citizens' rights still presents a significant hurdle. Though the Ecuadorian State provides adequate tools to address potential violations of rights, such as when preventive detention expires, habeas corpus remains a constitutional recourse for safeguarding individual liberties. Preventive detention, as the only legally sanctioned means to limit an individual's freedom without a conviction, must adhere to prescribed minimum requirements and rules. Recent jurisprudence, exemplified by Ecuador's Constitutional Court ruling 2505-EP-19/21, underscores that breaches of these requirements constitute violations of detainees' rights, thereby enabling the application of constitutional mechanisms to uphold rights enforcement.
