Las causas de situación de riesgo tramitadas en la Junta Cantonal de Protección de Derechos, del Cantón Riobamba, y las garantías básicas del Debido Proceso.

The Cantonal Rights Protection Board is a first instance administrative body, its function is to protect and guarantee the rights of minors, applying measures to protect children and teenagers from risky situations, in order to perform its function, it has to follow a due process established under current legal regulations. These legal regulations include the Constitution of the Republic of Ecuador, Organic Code of Childhood and Adolescence, Organic Administrative Code, among others; and respecting the major principle; the best interest of the child. The primary objective of the following research work is to determinate if the processes of the causes of the risky situations processed by the Cantonal Rights Protection Board of the canton Riobamba, accomplishes the basic guarantees of the due process, and for this to happen it was used research methods as the interview applied to the members of the Cantonal Rights Protection Board and to the judges of the Family, Woman, Childhood and Adolescence Judicial Unit, as well as the analysis of the judgments emitted by the same Unit. Accordingly, it was determinate that the basic guarantees of the due process are not been accomplished, omitting during the process the right application of the basic principles of it, such as motivation, celerity, the right of defense; not necessarily because the organism negligence, but because the lack of resources as technical equipment and qualified personnel.
