Περίληψη: | SUMARY O ABSTRACT The Ecuadorian Constitution establishes that all Ecuadorians and foreign aliens within the territory have the same rights. It has recognized work as any activity that helps people support themselves and their families. Within the current Ecuadorian regulations, the aim is to protect workers' rights, whether they are Ecuadorians or foreigners. Labor law in Ecuador has provided various forms of termination of the relationship. It has established that the termination of the employment relationship without just cause is constituted untimely dismissal for which the employer must pay compensation to the worker. Ecuadorian employers have decided to hire foreign citizens and violate their rights, arguing that they do not have rights within our country because they are not legal. International regulations on the protection of the rights of all migrant workers and their families have established a classification of foreigners. Foreigners are the documented or in a regular situation people. In this sense, those who have been authorized to enter are considered to establish themselves and dedicate themselves to an activity that is paid following what is established by the laws of each territory. Those who are undocumented or in an illegal situation are those who do not have the necessary documentation to enter the country. Foreign workers who do not have a work visa have the same rights as legal foreign workers, so their employers cannot violate their rights.
