“El trabajador migratorio indocumentado y la vulneración de sus derechos laborales en la ciudad de Riobamba desde el periodo 2018-2019”

Migrant workers without documents are people who enjoy innate and inherent fundamental rights simply because they are considered as migrants, regardless of their immigration status; rights that cannot be limited or suppressed by the employer. However, in reality the labor rights of migrant workers without documents are violated and consists in the non-enjoyment of the legal benefits that the Law grants to the worker in formal or regular conditions, since due to their immigration status they receive a remuneration less than the one determined by the Law, a circumstance accepted by them, because it is a remuneration greater than what they received in their country of origin, they also work in a state of defenselessness, excessive work schedules and their consent to be used at work is vitiated by their situation of need, which requires them to accept precarious and dangerous working conditions. Finally, all these factors determine that the employment relationship becomes a labor obligation, because migrant workers without documents are in a situation of fragility or legal risk and subject to the discretion of employers who take advantage of their situation and the lack of knowledge that many Migrants have about their rights, to use them
