Summary:In this research work, the objectives were based on defining the maintenance obligation, migration and the ways in which some people, especially fathers, leave Ecuador in search of new job opportunities that provide them with sufficient economic resources to support themselves and their children, who are left in Ecuador in charge of their mothers, who, in turn, try to take action to ensure that they comply with the maintenance obligation. In this sense, we used a qualitative methodology with a descriptive approach and a documentary and bibliographic design based on doctrine and national and international legislation, as well as interview and survey techniques, whose instruments were questionnaires that were applied to women who attended the UNACH clinics, as well as to family judges and lawyers in free practice with knowledge in this area in Riobamba canton. The results showed that the vast majority are unaware of the mechanisms and instruments with which Ecuador has signed and ratified specific treaties to carry out the collection of the aforementioned concepts; likewise, they do not use the exequatur procedure for the enforcement of judgments abroad. It was concluded that due to lack of knowledge of these elements, the jurisdictionally decreed maintenance obligations are not satisfactorily executed, recommending the necessary training on this so that justice operators and lawyers can make it effective and be able to provide mothers the protection that their children deserve in accordance with the Constitution and the laws of the Republic.
