Samenvatting: | The analysis of the principle of rapid processing of direct procedures, is in direct need for legal professional who operates in both the free practice and in the judiciary one, because it is necessary to deepen the knowledge on this subject, so that it will allow them to exercise effective administration of justice and prepare the defense of his client adequately. Therefore, throughout this research work, we try to clarify the legal effect and influence on the litigants when applying the principle of celerity in direct procedures in crimes of burglary, processed in the criminal court unit of the Riobamba canton during the period August 2014 to February 2015, as a legal matter now, determining the parameters, content and features. Thus, five units have been developed: the first unit is to clarify what is meant by the principle of procedural speed and as the principle of speed in the Ecuadorian legal system and possible legal effects that would cause its application. The second unit is about the simplification of the criminal process through the use of the principle of speed as a mechanism to get a trial within a reasonable time, taking into account the fair trial, the burden of proof in criminal law, to finally analyze the direct procedure. In the third unit robbery and especially the crime of burglary in setting things are analyzed, which are constitutive elements of the offense and the processing of this crime in the direct process is also analyzed. The fourth unit, has oriented research sampling of judgments in the Criminal Justice Unit of the canton Riobamba, during the period August 2014 to February 2015, to determine the influence of the principle of rapid processing of direct procedures concerning burglary in things. |
