| Sumari: | Shared ownership and paternal co-responsibility in accordance with the provisions of article 69, number 1 of the Constitution of the Republic of Ecuador, the State must promote paternity and maternity in a responsible manner, taking into account the rights and commitments of parents towards their children, in upbringing, pedagogical training, personal development, even when the parents are separated. The investigation resolved to find that in the Code of Childhood and Adolescence art., 100 establishes paternal co-responsibility, it`s the responsibility of the father and mother in relation to the protection of the rights of their children, to maintain affective relationships with their parents. According to what was mentioned, in the investigation an analysis of resolutions established in the shared possession processes was carried out, externalizing that the legal institution, not being with the Code of Childhood and Adolescence, was used by the Judicial Unit of Women and the Family, it is pertinent to know these resolutions and enforce the right of children to live with their caregivers. To meet the objectives of the work, a legal, doctrinal and critical analysis was carried out on the incidence of shared custody in the best interests of the minor and parental co-responsibility with an inductive - deductive method, which allowed obtaining important information. Field research where a survey was applied with the opinion of guarantee judges and lawyers in free practice. |
