| Crynodeb: | ABSTRACT The present investigation entitled "THE DISCRETIONALITY OF THE NOMINATING AUTHORITY AND THE JURISDICTION OF MATERNITY IN OFFICIALS OF FREEDOM APPOINTMENT AND REMOVAL POSITIONS", arises as a current problem between the discretion of the appointing authority at the time of cessation of functions of a woman in a state of pregnancy. Therefore, the purpose of this research is to describe the constitutional rights that violated at the time of cessation of functions of a woman who is under the jurisdiction of maternity, caused that the jurisdictional means activated in order to guarantee her rights. For the respective compliance, the research developed through the treatment of the constant theoretical framework in 3 units named: the first, administrative discretion, the second, referring to the positions of free appointment and removal, and, the third, on the maternity jurisdiction. The methodological design suitable for a social legal investigation, through the deductive, analytical and systematic research method; qualitative research approach; types of field, exploratory and bibliographic research; non-experimental research design. Additionally, information has been collected thanks to the research instruments, that is, the survey guide, with which it has been possible to draw conclusions and recommendations according to the problem presented in the respective research.
