| সংক্ষিপ্ত: | The present research work, titled “The Creation of an Economic Fund and Its Impact on EmployerProvided Retirement in Ecuador,” analyzes employer-provided retirement as a right established in the Ecuadorian legal framework. This right recognizes the work trajectory of employees who have worked for twenty-five years or more for the same employer. The benefit aims to compensate workers for their dedication through an economic payment at the end of their working lives. However, the validity of this right faces’ challenges arising from changes in the labor market. Staff turnover, unjustified dismissals, and new hiring modalities make it increasingly difficult for a worker to remain with a single employee for twenty-five uninterrupted years. As a result, thousands of workers are unable to access employer-provided retirement benefits despite having dedicated their productive lives to employment with various companies. Added to this scenario is the social security system, financed by the State and by contributions from both workers and employers, which considers the worker’s age and total number of contributions regardless of the employer. Given this reality, a reform to Article 216 of the Labor Code is proposed, creating an economic fund with joint worker-employer contributions, administered by the Bank of the Ecuadorian Social Security Institute. This fund would make it possible to recognize years of work accumulated with different employers and ensure access to employer-provided retirement in line with new labor dynamics.
