“La prescripción de la letra de cambio contra el aceptante y los efectos jurídicos sobre los derechos del girador en las sentencias dictadas en la unida judicial de lo civil con sede en el cantón riobamba en los años 2013, 2014 y 2015”

The purpose of this investigation was to investigate how the prescription of the bill of exchange against the acceptor affects the legal effects on the rights of the drawer in the judgments handed down in the Civil Judicial Unit with Headquarters in the canton of Riobamba in 2013, 2014 and 2015, the present investigative work within the legal field is developed in four chapters as follows: The First Chapter entitled Referential Framework, where it is put into consideration: the Approach of the Problem itself that has given rise to the investigation, Formulation of the Problem, followed is determined the Objectives by means of which has been established the way in which the prescription of the bill of exchange against the acceptor affects the legal effects on the rights of the drawer, and finally within the same frame of reference is the Justification and Importance of the investigation. The Second Chapter entitled Theoretical Framework, where the subject matter of the study is explained from the theoretical point of view, an ideal model is designed to theoretically guide the investigation, this chapter contains four units that refer to the theoretical scope of the research, in its Content consists of the following: The first unit deals with: The bill of exchange, in which we will find main concepts of topics according to the meaning of the bill of exchange; the second unit refers to: The prescription, likewise we find concepts, theories and legal norms; the third unit deals with: The prescription of the bill of exchange against the acceptor, which is the independent variable object of research and analysis of the present work; in the fourth unit it deals with: Legal effects on the rights of the drawer of the bill of exchange, which is the dependent variable object of investigation and analysis of the present work; and finally there is the fifth unit that refers to the hypothetical unit. In the Third Chapter called Methodological Framework, the verification of the hypothesis is carried out, through the interpretation of the data obtained in the investigation. The methods were used: inductive, analytical and descriptive, the techniques used were the interview and the survey. In the Fourth Chapter the conclusions and recommendations are put to consideration as a consequence of the investigation.
