Zusammenfassung:This research analyzes the lack of summons—defined as the formal legal notice requiring a person to appear or respond—as grounds for procedural nullity, the invalidation of legal proceedings due to fundamental errors, in administrative proceedings aimed at protecting children’s and adolescents’ rights. The study arises from a case in which mechanisms not provided for by law, such as telephone calls and instant messaging, were used, erroneously justified by provisions of the Organic Administrative Code. This raised concerns about how the Cantonal Rights Protection Boards issue summonses, which were addressed through a legal and documentary analysis, identifying irregular practices when summoning the accused. The results show that these practices not only contradict current regulations but also result in serious violations of due process (the legal requirement for fair procedures), the right to defense, and the right to effective judicial protection, thereby compromising the validity of administrative proceedings. The study highlights the urgent need to harmonize institutional practice with the specialized legal framework to ensure effective and timely protection of the rights of priority groups. Finally, it concludes that the declaration of procedural nullity due to failure to serve a summons, although rare, reveals structural and institutional deficiencies in the rights protection system. Institutional measures are suggested to improve the practice of summonses and ensure the effective protection of rights.
