El principio de igualdad en el otorgamiento de las medidas de protección, dentro de los procesos de violencia intrafamiliar.

In the current Constitution of the Republic of Ecuador, Art. 66 numeral 3 is found, in literals a and b where it considers the right to personal integrity, it also guarantees and emphasizes physical, mental, moral, sexual integrity and in what the duty of the State is to guarantee a life free of domestic violence in the public and private spheres. Under this preamble prescribed in the Comprehensive Penal Code, violence against women or members of the family nucleus will be punished and protection measures will be granted to eradicate it, this includes physical, psychological, sexual violence and also violations, in ratified international treaties by the Republic of Ecuador, as well as in the Inter-American Convention to prevent and punish violence against women. For such considerations, the administration of justice in the Republic of Ecuador is analyzed and under a perspective over time, the jurisdictional body within the processing of the processes in which the victim in this type of criminal offenses, since whether these crimes or misdemeanors are about a man, they do not act as effectively as when dealing with a woman, that is, the principle of equality is being violated. This limits the granting of protection measures that are only reduced to those contemplated in the Organic Comprehensive Criminal Code in its art. 558 numerals 1,2 and 3 being the latter in the best of cases, but women are granted all and granting the aid ticket which for a man is not granted.
