Summary:ABSTRACT: Digital loans are operations offered by financial institutions that are characterized by being automatic, remote and instantaneous whose purpose is to cover liquidity needs, their use has increased as the implementation of technology expands. Once this credit product has been contracted, obligations and rights are generated by the users and the financial institution, consequently, the objective of this research is to carry out a legal and critical analysis of the credit products offered by financial institutions and the rights and obligations of entrepreneurs of the popular and solidarity economy in order to establish the legal consequences of the lack of regulation on the customers of the market. monetary and financial system. The methodology applied was historical-logical, legal-analytical, legal-doctrinal, descriptive; The research had a qualitative approach, with a non-experimental design, and a basic, documentary-bibliographic, descriptive and analytical approach; which made it possible to establish as a result that digital credits in the Popular and Solidarity Economy sector are expanding, making it necessary to protect the consumer of their rights, as well as the rights of the financial institution to make effective the recovery of overdue obligations, respecting due process.
