“El debido proceso y su incidencia en la justicia indígena en el cantón Colta, provincia de Chimborazo, periodo enero – diciembre del 2016”

Indigenous justice as a constitutional and legal way of administering justice in the nationalities and indigenous peoples of Ecuador has been harshly questioned by jurists, politicians, social communicators and citizens, within the discussions, it has been stated that the ancestral execution violates the basic guarantees Of due process; with the purpose of clarifying this question, the present investigation was carried out that had as objective to describe through the study of cases because due process affects indigenous justice, to reach the end, within the investigative process a legal, doctrinal study is carried out And a critic of the legality of customary law, analyze the procedures and crimes that were processed in the administration of indigenous justice in the Colta Canton, Province of Chimborazo during the January - December, 2016 period; To collect the information in the place of the facts was applied the technique of the survey and interview, the results indicate that due process SI affects indigenous justice, because it guarantees efficiency, effectiveness, impartiality, transparency and integrity in this way to do justice.
